Terms of Service

These Terms of Service ("Terms") govern your access to and use of PicSwipe, including the mobile app, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

These Terms are a binding agreement between you and PicSwipe. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old (or older where required by law) and capable of entering a binding agreement.

3. License and Service Access

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

4. Subscriptions and Billing

Paid features may be offered through auto-renewing subscriptions or one-time purchases in the Apple App Store. Billing, renewal, cancellation, and refunds are handled by Apple under Apple's terms and policies. We do not directly process your payment card details.

5. Acceptable Use

• Do not misuse, reverse engineer, or disrupt the Service
• Do not attempt unauthorized access to systems or accounts
• Do not use the Service to violate applicable laws or third-party rights
• Do not interfere with other users' use of the Service

6. Third-Party Services

The Service may rely on third-party providers, including Apple, RevenueCat, and ad or analytics providers when enabled. Your use of third-party services is also subject to their terms and privacy policies.

7. Intellectual Property

PicSwipe, including its software, content, visual design, logos, and trademarks, is owned by PicSwipe and protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

8. Service Changes

We may update, modify, suspend, or discontinue features at any time. We are not obligated to maintain any specific feature indefinitely.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PicSwipe WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE.

To the extent liability cannot be excluded, our total liability for all claims related to the Service will not exceed the greater of (a) the amount you paid for the Service in the 12 months before the claim, or (b) USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless PicSwipe from and against claims, liabilities, damages, losses, and expenses arising out of your misuse of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required to protect the Service, users, or legal compliance.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You and PicSwipe agree that disputes arising out of or relating to these Terms will be resolved exclusively in state or federal courts located in Santa Clara County, California.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide additional notice where required by law. Continued use of the Service after updates means you accept the revised Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you andPicSwipe regarding the Service and supersede prior agreements relating to the same subject matter.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Failure to enforce any provision is not a waiver of future enforcement of that or any other provision.

PicSwipe is intended for users in supported regions and may not be available in all jurisdictions.

You are responsible for your own backups and device management, including confirming deletions before finalizing media actions.

Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

Some jurisdictions do not allow certain disclaimers or liability limits, so parts of these Terms may not apply to you.
